Sexual Violence and Harassment Policy
Application
This sexual violence and harassment policy applies to all Career College students enrolled at Stratford Air Services Ltd.
Scope
The policy applies to complaints of sexual violence or harassment that have occurred on Stratford Air Services career college campus or at a Stratford Air Services career college event and involve Stratford Air Services students.
Purpose
All Stratford Air Services Career College students have a right to study in an environment free of sexual violence and harassment. The intent of this document is to set out Stratford Air Services policy on sexual violence and harassment, define prohibited behaviours and detail our investigative processes for sexual violence and harassment.
Policy Objectives
Stratford Air Services is committed to providing our students with an educational environment free from sexual violence and harassment. Students who report incidents of sexual violence or harassment shall be treated with dignity and respect. Stratford Air Services shall provide this policy to all Career College students enrolled with Stratford Air Services. Company staff shall review the policy with the students and ensure that they understand their rights as outlined in this policy. All Stratford Air Services staff shall receive training appropriate to this policy.
Identifying situations that involve or could progress into sexual violence or harassment and the means to reduce (address) this behaviour shall be discussed.
Stratford Air Services shall take all reasonable steps to investigate all sexual violence and harassment complaints made under this policy. The following process is used to respond to and address all incidents and complaints involving students.
- Provide on-campus investigation to students experiencing sexual violence
- Respond promptly to any complaint and provide reasonable updates to the complainant and the respondents about the status of the investigation
- Assisting students in obtaining counselling and medical care
- Provide students with appropriate accommodation
- Provide students with information reporting options
Definition of Sexual Violence
“Sexual Violence” means any sexual act or act targeting a person’s sexuality, whether the act is physical or psychological in nature, that is committed, threatened or attempted against a person without the person’s consent, and includes sexual assault, sexual harassment, stalking, indecent exposure, voyeurism and sexual exploitation.
All students affected by sexual violence may seek support, services and accommodation by contacting the president or through a sexual assault centre as listed in Appendix 1 and Appendix 2. A formal report of an incident of sexual violence is not required to access available services.

Reporting and Responding to Sexual Violence
All staff and students shall take all reasonable steps to prevent sexual violence involving students on campus or at any Stratford Air Services event. If a student has been subject to, witnessed, or have knowledge of sexual violence involving students, or have reason to believe that sexual violence has occurred or may occur shall immediately report the occurrence to the president of Stratford Air Services. If students in good faith, report an incident of, or make a complaint about, sexual violence, they will not be subject to discipline or sanctions for violations of the career college’s policies relating to drug or alcohol use at the time the alleged sexual violence occurred.
Upon receipt of a report of sexual violence, appropriate support shall be offered to the person who has experienced sexual violence and to any person or group against whom an allegation of sexual violence has been made. The president recognizes the complainants may choose not to request an investigation by the school and that the complainant has the right not to participate in any investigation that may occur. The president recognizes that the complainant’s choice should be respected whenever possible.
The president may, in certain circumstances be required by law to initiate an internal investigation and/or inform police without the complainants consent, if there is a safety concern for students or staff. This requirement seeks to balance a complainant’s choice with our school’s obligation and to ensure that complainants understand that they cannot be compelled to participate in the investigation.
Investigating Reports of Sexual Violence
Any Career College student may file a written complaint concerning sexual violence. This complaint must be received by the president.
During every stage of the investigation or decision making process, the complainant has the right to be accompanied by another person. The choice of this person rests with the complainant.
Students who disclose their experience of sexual violence through reporting an incident of, making a complaint about, or accessing supports and services for sexual violence, will not be asked irrelevant questions during the investigation process by the career college’s staff or investigators, including irrelevant questions relating to the student’s sexual expression or past sexual history.
The president, upon receiving a complaint of alleged sexual violence shall initiate an investigation. This investigation shall be a separate function and not combined with any civil or criminal investigations which may occur.
The following process shall be used.
- Determine if the incident should be referred to police
- Meet with the complainant to verify the date and time of the incident, the persons involved, any witnesses and a detailed description of the incident
- Determine what interim actions need to be taken during the investigation
- Interview any persons involved in the incident
- Interview any witnesses to the incident
- Interview any person who may have knowledge of any similar incidents related to the complainant.
- Inform the accused of the complaint
- The accused shall have the opportunity to respond to the allegations
- Investigation status shall be conveyed to the complainant and the accused
- Upon completion of the investigation, a decision on disciplinary action if required shall be made
Disciplinary Actions
If it is confirmed that a Stratford Air Services Career College student has been involved in an incident of sexual violence immediate corrective action shall be taken. This action may include student expulsion. Any Stratford Air Services staff member involved in any incidents of sexual violence shall be terminated immediately. Stratford Air Services shall assist all agencies involved if criminal proceedings are initiated. All parties involved have the right to appeal any disciplinary actions resulting from the investigation process.
Privacy and Confidentiality
Stratford Air Services recognizes an individual’s rights to privacy and is committed to maintaining accuracy, security and confidentiality of students and staff personal information.
All personal information pertaining to complainants of sexual violence shall be protected to the extent possible, but may be precluded if an individual may be at risk of self-harm or harming another, or if reporting is required by law.
False Statements
Anyone who knowingly makes a false complainant of sexual violence or provides false information regarding a complainant is subject to disciplinary action, which may include expulsion or termination of employment as a staff member.
Reprisal
No person shall retaliate or threaten to retaliate against anyone who has brought forward a complaint of sexual violence, provided information related to the incident, or been involved in the incident investigation.
Statistics
Annual statistics detailing all occurrences of sexual violence and all support services offered to any person involved with an act of sexual violence shall be compiled and retained by Stratford Air Services.
Stratford Air Services shall collect from its students and other persons, and provide to the Superintendent of Career Colleges, such data and other information relating to the following as may be requested by the Superintendent, in the manner and form directed by the Superintendent:
- The number of times supports, services and accommodation relating to sexual violence are requested and obtained by students enrolled at the career college, and information about the supports, services and accommodation.
- Any initiatives and programs established by the career college to promote awareness of the supports and services available to students.
- The number of incidents and complaints of sexual violence reported by students, and information about such incidents and complaints.
- The implementation and effectiveness of the policy.
A career college shall take responsible steps to ensure that information provided to the Superintendent does not disclose personal information within the meaning of section 38 of the Freedom of Information and Protection of Privacy Act.
Stratford Air Services shall review this policy at least once every three years and amend it as appropriate.
